The study examines the privacy and data protection obligations that are imposed on private actors such as companies upon their development and production of new technologies. The work will compare the European and United States privacy regulations and aims to provide a comprehensive general description of all legislative and other obligations especially when international companies that operate in multiple jurisdictions are concerned. The purpose of the work is to observe the differences and similarities between the respective approaches in regulating data protection obligations, and how these obligations are enforced. The thesis will focus on providing an annotated general description of the EU General Data Protection Regulation, which is currently under preparation, in comparison to the fairly dispersed field of information privacy within the United States. The purpose is to assess the significance and weight of certain fair information principles that lie in the legislative background, principles such as Privacy-by-Design, Privacy-by-Default and Privacy-enhancing technologies will be treated. The conclusions will provide a short overall assessment how companies should abide by and act with respect to the manifold data protection obligations they encounter.
