In my thesis I will analyze discrimination as it appears in different types of contractual relations and propose my own interpretation on the application of valid law that deals with equality and inclusivity in the Nordic countries. The main focus of my thesis is the legislation and case law of Finland, but I will also refer to the legal systems of Sweden, Norway, and Denmark for comparison. It can be summarized that the most common factors that may result in a person experiencing discrimination are his gender, age, nationality, disability, health, language, religion, and political or ideological convictions. My thesis will explore different instances of discrimination in various contract types, such as consumer contracts, work contracts, and contracts between businesses, as well as long-term contracts. I have also selected a few topics for more thorough analysis, such as discrimination occurring in the workplace and discrimination based on gender. My aim is to form a general principle on the application of the relevant legislation: do national courts interpret the law leisurely or strictly, are there differences between contract types, is one party favored over the other. I also explore so called permitted discrimination in my thesis, with a particular emphasis on comparing the wording of various laws of the Nordic countries. Lastly, I will also present my own thoughts about the state of the valid legislation in addition to offering possible outcomes for future development.
